I have recently filed for divorce after 23 years with my stbx. He was having affairs - his hobby! and was violent throughout our marriage. He is currently on bail charged with my attempted murder . He hit me on the back of the head with a hammer and then tried to suffocate me - our 19 year old daughter saved my life. As you can imagine we are all still struggling to come to terms with whats happened - I also have a 17 year old son. I earn a good salary but both kids are students and have no income. He has lost his job so is claiming job seekers allowanace whilst running up massive debts on credit cards. I am struggling to pay a £185k mortgage and credit card debts and trying to keep sane before going to court in March. Will all this be taken into account in the divorce. I feel as though he is still playing mind gamed with me and that as our children are older we may be forced to sell our home. The house is only worth £210k

Yes, this is a really nasty one, and is, in my opinion, one type of case where conduct would be taken into account. The Courts won't tolerate serious violence and quite right too.

I think it is most unlikely he would get spousal maintenance ( where he's going he won't need it ! ) but do you think you could afford to keep the house ?

If you have a debt problem, there are ways of dealing with it. You need to give priority to the mortgage payments, and other priority expenditure like Council tax.

The CAB used to do a booklet on how to manage your debts and it may be worth your while asking for one. It is free of charge and contains much useful advice.
