What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

My ex wife and I divorced several years back in a non contested divorce.

In the agreement I got the house (As she wanted nothing to do with it and moved back to NY). In the divorce it stated that I had one year to refinance to get the home out of her name. A little presumtuious on her behalf. I tried within that time frame to refinance but my mortgage company denied me due to the resent housing crisis and my house not appraising at a high enough value. I cannot do an assumption because of my credit score. With that being said, she said that by still having the house in her name she cannot get the amount for student loans she needs and threatens to take me to court to force me sell the house. Is this possible? Please....any advice in getting her name off of the deed and loan would be most appreciated.

Hi there

I am sorry, this is a UK site, so I doubt anyone will be able to help you with the legal aspects of your case.
