What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Both my stbx and I have solicitors, so far it has cost £2000 each and nothing has happend.
Now after 15 months stbx and I can communicate ( through clenched teeth ) and have agreed a 45-55 split in my favour, with me taking on any debt which is minimal. We have agreed not to look at each others pensions as neither is great.
We have completed a deed of separation. So do I need a solicitor or can I just put that through the court ? I also have my nisi but not the absolute. Can I complete that without solicitors too?

Thanks in advance.

HI.
I would suggest looking at the Consent Order service on this site. It is a fixed fee & as long as you are both in agreement about the assets and finances - which it sounds like you are - they can use the terms of your Separation Agreement to draft a legally binding consent order that will be acceptable to the judge.
You will each need to get a CETV for each pension.
This is required even if you are only presenting them for dismissal. It is just proof you know what the values are.
* Look at the pension forum for advice*

I self repped my divorce & we were in agreement, so used the consent service for the assets and finances. Saved £££.

6 weeks & 1 day after your absolute you send £40 and the application for the absolute to the court dealing with your divorce. No sols needed, unless there is something complicated going on.
But make sure assets and finances are written in stone first.
