Please help...... Alimony?

Hi all,

My wife and I had been together for 6 years and married for just under 1 year. A few years a go the relationship started to fail, but we had planned marriage, and well, we got married. After just 10 months we have now separated, I have moved out into a flat share, and my wife is living in our marital home, for which we have both agreed to pay half the costs, for the time being.

We have no children.

We have a number of debts to credit cards and loans, and ideally need to sell the home as soon as possible and repay the debts and mortgage, however my wife is refusing to sell the home, and is trying seek alimony? What can I do?

Please help.

I could not advise for certain without knowing more of your finances but on the basis of what you say I would say it is unlikely that maintenance would be ordered for anything more than a shortish period. One exception might be if the wife is disabled.

The most likely order would be an order for sale, which frees both of you from the debt and enables both of you to start afresh.

I could not comment more without knowing your finances in much greater detail.

In Scotland spouses have a duty to maintain each other and if your wife cannot afford the mortgage and bills until the finance and divorce is sorted she can claim 'aliment.'

I would suggest seeing a lawyer to find out where you stand and what the options are.
