Dear all,

thank you for the previous advice on a notice to show cause.

Some quick facts on my case:

I am 32, make 80k pre tax, live in a home with 50k equity and 350k mortgage. I am the sole carer of my 5 year old son.

my ex has a property of 825k no mortgage, bought before we married (though while we were co-habiting) which we lived in for the entire marriage. She has mo job but receives support from her parents (87k at last disclosure).

we were together 6 years married for 2.5 years.

After the judge questioned the fairness of the last Consent Order (agreed pre fdr) of a lump sum to me of 45k, the other side agreed an oral WP of 37.5k to me with a letter supporting the fairness of the deal.

The other side is fully represented by solicitors and I have been using a direct access barrister.

There are currently disagreements over whether the oral wp offer made and accepted should mean there is a total Clean Break or whether it could also leave scope for the respondent to provide ongoing support for our son’s extracurricular activities.

If anyone on the forum has advice on whether there is scope post oral offer to negotiate terms which could be placed in the consent order beyond the point that was agreed of a lump sum and letter of support of fairness, it would be most appreciated.

Problem with having child maintenance in a consent order is that either party can go to the CMS in the future and their assessment would override it.
