Hope someone can help..

My stbx has been trying to get out of the prison service for 8 months on medical retirement/inneficiency. Anyway something has happened as he is now in receipt of a benefit.

I found this out i a double whammy.

1. I applied to the CSA as he stopped paying maintenance and they came back with a Nill entitlement as he is in receipt of a benefit!

2. I recieved a letter today from the building society to say they had completed the interest payment form for the DWP.

Now i believe he has had some sort of payout from the prison service but what i do not know? It will come out as we are going through Ancillary Relief.

But will the Social pay all the interest on the mortgage as i am a joint name on it and i work full time with a good salary? He still lives in the MH i rent a house with our daughter.

Also does anyone know if he will be entitled to public funding now for our ancillary relief. Even though he has got a lump sum and also £20,000 worth of equity in a holiday villa that is for sale? If so will he have to pay it back.

He has gone on benefits to spite me!

One more question if he was medically retired would he still be entitled to claim benefits??

I need to stop letting him wind me up :(

Hi,

Am not sure all all your points but i cannot see him being entitled to legal aid with 20k in the bank plus a holiday villa to his name! The legal aid pot is being drastically reduced and conditions for qualifying are going to get much harder.

Your right though all of this will have to be declared as part of financial disclosure.

Hope this gets sorted out for you.

Thanks for your response. He does not have £20,000 in the bank that is his share when the villa is sold.
He has had a pay out from work but not sure how much.

I thought as he was in receipt of a benefit Employment support or something i thought that passported him through to legal aid??
