if the my other half in=s on legal aid and he is the one who filled the divorce. would I have to pay any court cost

Would be surprised if the other half is getting legal aid. But if his income is low enough he can get a remission of the fee for filing the Petition. Have a look at form Ex160a

This is a slightly ambiguous question. The Petitioner can claim costs from the respondent if they choose to but if no costs are incurred there are no costs to claim back.

So, as PP says, if there Petitioner acts as a litigant in person and is entitled to fee remission, there will be no costs to pay but if the Petitioner has to pay something - court fees, solicitors fees etc, they can claim this back from the respondent.

Hi alexandra,

Can I just point out that legal aid is not free and ended on 01/04/13 so If your stbx had not had an application for legal aid granted prior to that date, will not be getting it.

If they are getting it, the solicitors fees are at a lower rate and all the legal aid has to be paid back at the end of proceedings, any outstanding monies incurs interest at 8% per day.

Hi there,

thank you for your reply, But I think if you have already receive Legal Aid before April 2013 it carries on until the case finishes. can anyone clarify this. Does it carry on even if you have legal aid before April 2013?
