I am William, the Child Maintenance Options consultant. I understand the Child Support Agency (CSA) has contacted you informing you of the amount of your child maintenance payments. You would like some clarification, and further information relating to how your payments have been calculated, and how you should make them.
Your responsibility to pay child maintenance starts from around the time that the CSA first contacted you, and not from the point that the application was made.
With regard to how you make your payments through the CSA, the CSA have two maintenance options available, which are called Direct Pay and Collect and Pay. Direct Pay is where the CSA will make a maintenance calculation and then allow you and your ex-partner to decide on how payments will be made. Once they have calculated the maintenance amount, the CSA will not contact you or your ex-partner again, unless either of your circumstances changes. However, in order to put in place Direct Pay both you and your ex-partner will have to agree to do so.
The Collect and Pay service, is where the CSA calculate, collect and enforce payments on you and your ex-partner''s behalf. Some people prefer the security and help of third party involvement. There will be no charges introduced for using this service under the CSA.
However, the Government plans to introduce a new statutory maintenance service, called the Child Maintenance Service and there maybe costs involved, such as an application fee, fees for collecting and paying out child maintenance payments as well as enforcement charges for paying parents who do not pay. Currently only parents with four or more children are eligible to open a case with the Child Maintenance Service. Everyone else will still use the CSA.
We do not know the exact amount of the costs yet or when they might be introduced as they still need to be approved by Parliament, but the Child Maintenance Service will write to everyone with a case to confirm the exact amounts at least a month before they come in.
As the Government introduces the new service to everyone, the CSA will start closing their existing child maintenance cases. You and your ex-partner would then have to decide whether to make a family-based arrangement or to apply to the Child Maintenance Service. Help and support will be in place so you can make the right choice for your circumstances.
