Paying Direct to My Children so Wife Does Not Spend on Herself

So I am a NRP and my kids are 14 and 15. I pay a lot of money to their mother via a Consent Order. She earns around £100k herself and she has remarried to an earned. She does not spend that money on the kids. I have been begging her for example to get the eldest a tutor but she will not pay. Believe me when I say I pay a LOT and I had wanted the money to be spend on private school. He is in state and not doing as well as he could.

The maintenance arrangement goes on until finish of tertiary education ( I understand this means bachelor's degree)

Ok so here is the plan. Wait until eldest child is about to turn 18 ( but importantly before he is 18) , register with the CSA which will cancel out the consent order. Continue paying her at the same level so she has no reason to go to court. Once the eldest reaches 18 stop paying her his child maintenance and pay to him directly for university. He is the only one who can apply for child maintenance at 18 not her.

Dos anyone see any flaws in this. I would then do the same with the other child. It is not a plan to save money ( I love my kids and want the best for them) I just want them to have the money.

Is the order purely for child maintenance?

If there is a spousal maintenance element, i am surprised it has not been negated by remarriage.

If the order says you have to pay until the end of first degree, then that is what you would have to do unless you have applied to the court and been granted a variation.

I think you need to get someone with good legal knowledge to look at the precise terms of the order and advise. You csn book a fixed price legal financial consultation via the website.
