I have 2 children, 10 & 8, the younger having learning difficulties and unlikely to ever be independent. I have been for one meeting with a solicitor and was told that I couldn't expect any extra maintenance for myself, even though my earnings are limited because I have to work round school hours/holidays - there being no suitable childcare for the disabled child, and I am permanently exhausted as he has disturbed sleep. She did however suggest I could reach a slightly more advantageous split on the house.

I think my stbx has had different advice from his solicitor as he has mentioned not being able to have a Clean Break because of X. We are not on good enought terms to discuss frankly.

Does any one have any experience of divorce with disabled children?

My younger child is disabled there was no FMH to argue about ex wanted a clean break and was told by judge this was not a clean break case.My ex has been ordered to pay x amount for life as noone knows what the future is going to be for my boy.

I do know of one final hearing where the judge decided that the two children (both in thier twenty`s) should be viewed as children because thier severe disabilitys meant they would never be independant of their mother.

I have a son with special needs - autism. There was no agreement specifically to him.

He does qualify for DLA though (I didn't find out about this until after I'd divorced), which has helped, as he does need extra care. And I have Carer's allowance too as I'm at home at the moment.
