Just to let you know I phoned to make a complaint and they are "now telling me they have not based payments on childs statement" Hmmmm!!

Although they have now stated they received a calender of dates from my stbx listing almost double the number of days he actually has him and are basing payments on this. This seems wrong as I suppled calender of dates my also. Why is this not being being considered.

If it were only a few pounds I wouldn''t mind but its approx £70 per month being underpaid. I am going to appeal decision, but again its his word against mine, what are we to do?

With no contact order and no established pattern of contact then the onus is going to be on him to prove his argument.

can you disprove any of the dates with evidence such as receipts for tickets because you were somewhere for example.

Introduce some doubt and it will blow his argument. At the end of the day anyone can make up dates on a calendar but the person making them up will often make school boy errors.

Does his invention include any dates where your child was in school and / or attending a club or organised activity? If so, could the school / organisers Confirm if was you doing pick up and drop off? Ie, the child was with you.

Csa won''t divulge actual dates stbx states has child just the number of days he''s stating he has him ...... I do keep receipts but we don''t really spend on days out etc as we can''t afford.... So don''t really know what to do just accept defeat perhaps!

I do have letters I sent to my solicitors about his lack of contact & my solicitor writing to his.....but have never received a reply letters all ignored...(but I ''ll send these). I can''t afford to do contact through court as we''re already in court re AR 3years now & my energy & costs for this are escalating....

I wish I was earning enuf to cover all costs & we cld sort ourselves out ... It''s a shameful predicament to find yourself fighting for £70 per month for ur child after 23 years marriage

This is horrendous. I feel for you, how on earth can you prove which nights a child spent with you unless you can produce cinema tickets etc (who can afford that every night??). Good luck with your case, I hope you win!

I will certainly think twice before entering into a battle with CSA!
