can my ex wife claim part of my redundancy payout?

Hi

I am about to be made redundant. I divoreced my ex wife 3 years ago and have been paying CSA payments for our two girls since. I am going to start fresh in a new career but need to retrain first so I will need all of the money i get to keep me going until i get work.

Can my ex-wife take any of the redundancy payout and claim it for part of the child maintenance?

i will not want to sign on for benefits and wouldnt want to but does this mean that the CSA will expect me to pay their payments from my redundancy money?

Any advice would be appreciated

My inclination would be to think that, if you were made redundant, your income would cease and therefore your CSA payments would be drastically reduced, perhaps even to nil or at any rate £5 per week.

The odds are that your redundancy payment would disqualify you from means tested benefits, at least for a time.

Whether she could claim any of the payment would depend on the termsa of your divorce. If her claims have been dismissed, then she couldn''t.

I would suggest you contact the CSA directly, to discuss your concerns. The number should be on the letters you have received, or you can find the right number here: www2.dwp.gov.uk/csa/v2/en/contact/index.asp.

You need to let the CSA know of any change in circumstances. My understanding is under the current scheme redundancy isn''t considered income for assessing ongoing child support.

However if the CSA is collecting maintenance payments redundancy is counted as income when calculating payment of any arrears.
