I feel for you.

I raised this very point with the CMS lot and was told that if i couldn''t prove my time with the kids by the way of some sort of court order, they would take my stbx word for it.

basically if you are the nrp, you''re stuffed.

I just dont understand why there is not equal rights in the family courts.

Get your court order and get this sorted sooner than later.

The FDR was on 31st of July. She let me have daughter on the first weekend (1st - 3rd August) because the judge put it in the court order for me to return the keys to the family house when I returned daughter on the 3rd so she had no choice. Therefore its my weekend this weekend coming. So my ex has now said I cant have her anymore because she wants more CSA. I have text messages confirming this but the CSA are not interested as they take her word for it unless I have the court order.
Lets hope the court move quickly to sort it all.

the whole CMS system appears to hold the NRP to ransom.

I hope you don''t get whacked with the forthcoming 20% ''admin'' charge if your ex decides to punish you even more by going through collect and pay just for the hell of it...

whatever you do, don''t pay cash - make sure that there is always a paper-trail behind you. I hope she co-operates very soon and provides the bank details.

I would wait and see what happens this weekend - perhaps send a short email tomorrow stating that you intend to collect daughter as usual on Friday - if she replies that it''s not happening then you have written confirmation of her intentions to unilaterally stop contact (text messages aren''t reliable for this). Then it would be time to submit your C100 first thing on Friday or Monday. Make sure that you are making the application for the right reasons - ie so that your daughter can have proper time with her Dad, as she had been before, and not just for something to show to the CMS.
