Hi,

If you have an agreed plan put in place by the CMS, can this be challenged/increased through the courts by the way of separate additional payments?

Or is it the case that once the a plan is agreed with the CMS, any variation needs to be managed through them?

Normally the courts have no jurisdiction to impose an order or variation for child maintenance. The exceptions are when one parent lives abroad, there are stepchildren, children over 18 in education. HOwever it is possible to apply for top up payments if the paying parent''s gross income exceeds the CMS capped amount of £3k/week. The courts can also make orders to cover school fees or special expenses related to a child''s disability.
