When there is no court/Consent Order settling the finances either party can claim against the other in the future even though they are divorced. That means if one of you wins the lottery or comes into an inheritance the other could potentially make a claim, although after six years it''s difficult to prosecute a claim. Therefore it''s advisable to tie up the finances formally with an order dismissing future claims.

As I said above instead of using the child maintenance Service child maintenance could be agreed as part of a legally binding and enforceable Consent Order.

In regards to the separation order you have, if you have any concerns with it, you may wish to seek legal advice as to where you stand regarding this. Civil Legal Advice is a free and confidential advice service paid for by legal aid. Their contact centre provides independent advice about debt, education, Discrimination, housing, family and welfare benefits to people who live on a low income or benefits. www.justice.gov.uk/legal-aid Alternatively, you may wish to speak with your solicitor.
