3 children 17 13 11.father left 11 weeks ago promised oldest that he could live with him but he hasnt let him move in yet.

he only pays voluntary maintainance for youngest 2 and hasnt offered any money for the oldest.
oldest boy has his room here all official correspance sent here and stays between here and girlfriends.

stbx has now decided that he wants me to sign over chb to him.
can anyone advise.
dont want to get into trouble but he does not live with him.

I would agree to having it signed over to him once he has moved in just be carefull that he doesn''t move him in get the cb signed over and then send him back home to you.

Under child support legislation, regular child maintenance payments must be made until a child is 16 years old, or 20 if they are in full-time, non-advanced education (A-level or equivalent), or for as long as Child Benefit is being paid. Before 10 December 2012, the upper age limit was 19.

However, if your child was 19 after this date and in full-time education, maintenance would be paid until the age of 20. In addition, if arrears have built up on a case, those arrears must still be paid, even if regular child maintenance payments have stopped.

When a child leaves full-time education in the summer, Child Benefit generally continues until the first week of September. If you would like further information on when child maintenance payments end and for the courses that are classed as full-time education, you may wish to visit the following website www.gov.uk/when-child-maintenance-payments-stop

thnks for that willim.
oldest boy is 17 in full time education.
when his dad moved out he said he could live with him and so doesnt pay any child maintainance for him but this hasnt happened.
my son splits his time between me and his girlfriends house.

we have no formal arrangement re cm .
maybe this should be my next step because at the moment he just gives me money if he feels like it.

Child maintenance is paid to the parent with the main day-to-day care of a child and who is in receipt of the Child Benefit. Child maintenance can be arranged via a family-based arrangement, which is not legally enforceable. The Government’s statutory scheme, the Child Maintenance Service or via a Consent Order/Minute of Agreement.
