Woohoo almost there, just the last thing to tie up officially!

I have been paying maintenance for one child at £200 per month which was generously over what CMO calculates, however ex has got a little greedy for my liking as I was working more hours and back in Nov asked me to pay more. I refused and said I would consult CMO calculator which she did not like. During negotiations over Consent Order I got CMO to calculate for me by email and I find I am paying £90 over the odds so I decided to negotiate but she is having none of it! I am generous with support outside, school bus, school uniforms etc and treats when he is with me.

Could anyone give any advice or any opinions??

If she wont negotiate then basically you have two options.

Pay what she tells you.

Ask CMS to assess and pay that.

Thanks for that advice. My concern is that if i go for the latter option so that i am not giving in to her demands she will try to limit contact.

Hello Rajpoot

If you have a Consent Order in place you may wish to see what is stipulate within your agreement regarding your payments. Alternatively you may wish to seek legal advice.

Any Consent Orders that were endorsed after March 2003 are not legally subject to change unless they have been in place for at least 12 months. After 12 months, either parent can apply to the child maintenance Service and the Consent Order will no longer be valid. However, if a Consent Order dates back to before April 2003, then law does not allow parents to change over to the Child Maintenance Service. Only the courts can arrange child maintenance in such circumstances.

Thanks William I wasn''t aware that this could be done with a post 2003 consent order. We don''t have one yet as this is still being drawn up one of the items being child maintenance.

The amount is the stumbling point and her current stance is that she is on a "fixed" income (which has incidentally risen since we separated due to a new job) and i have been paying that amount for three years and it will be detrimental to our son if i drop the amount. When i have raised dropping the amount in the past she has retaliated with threats to stop or reduce access.
