I had to appeal awards with CMS and had to enlist the help of my MP to get replies. They have done a mandatory review but rejected it due to inadequate evidence!! My issue is over the amount of nights that I have my son and the fact that also when cms discuss with my ex and she disagrees they just take her word!! When I spoke to them and asked what evidence would suffice they said court documents - this is despite them initially advising that is was best to sort without court - catch 22!! I can prove the nights as my dad wrote a letter in support and would be happy to provide an affidavit if necessary. I have been offered the option to appeal via the courts and tribunal and wondered really if this is worth doing?
