Have received a letter from my ex-wife's solicitor that she is seeking an agreement for both of us to forgo any future spousal maintenance or child support. (We are in the early stages of negotiation). I was the stay at home dad for the last 6 -7 years and I'm currently not working. My type of work has mostly gone overseas and there is just about no chance that I would be able to do the same type of work. Additionally having been out of the job market for an extended period of time and turning 50 early next year my job prospects are not great and it may take some time for me to find employment. She has quit her job about a week before she told me that it was over between us. She is currently not working either. I do not intend in receiving support from her if it can be avoided. I'm also wondering if I do forgo payments if it will affect my Family part A and B payments.Since I have elected not to receive payments from her, I believe Centerlink would possibly slash payments to the minimum amount. Any thoughts, advise would be much appreciated.

I am not familiar with the law in Australia but I umagine, as in the UK, a lot will depend on the arrangements for the children. Will they live mainly with one parent or will care be shared equally?
As you have been the main carer, you would have a good case for continuing.

Here you are expected to maximise your income so if she can work, she would be expected to do so as would you. Here also you cannot sign away your rights to maintenance for the children. Even if it is agreed between you, an application for statutory maintenance can still be made.
