CMS payments and school fees

Hi everyone - my ex-wife has just opened a cms case and I will be the payer. When we got divorced the Consent Order stated “the respondent (me) will pay periodical payments to the petitioner for the benefit of the children arising from their attendance at X X school. The payments will be the school fees and agreed extras.....we, the undersigned, understand.....if we do not comply with the same.....we will have committed a contempt of court....and sent to prison”

The cms person said that they over ride any court order but wasn’t sure if this over rides everything ie I still need to pay respondent periodical payments for school feee plus the cms maintenance amount.

If anyone could advise I’d be very grateful. Many thanks

The clause about school fees would be a sum to be paid over and above statutory child maintenance for a specific purpose.

So this still has to be paid as well as the CMS maintenance amount.
