missed cms payments

Hi - in february 2021 cms calculated that mother of my son should pay me £105 a month. I haven't received any payments at all and cms are too busy to answer my messages or calls. I've asked them to collect payments but still nothing. mother has now relocated to ireland. any advice on how i could get the cms calculated amounts please? many thanks

THe CMS will first will contact your child’s other parent to find out why payments have stopped. If possible it will start up payments again and agree to clear any arrears and try to arrange an agreement with the paying parent for missed payments.

If the CMS can’t reach an agreement, it may apply to the court for liability order. The CMS has a range of legal enforcement powers it can use – such as using bailiffs, disqualification from driving or imprisonment. Only one method can be used at a time.

Make sure you keep a note of each and every time you try to contact the CMS - including who you spoke to, the method of communication such as letter/email/phone call.

If you aren't getting any joy from the CMS, it is worth writing to your MP for help and assistance.
