Hi All,

Filed a Clean Break divorce many years ago along with a Consent Order to cover CM. It included an amount and a statement regarding how we would review this annually.

We have just decided between us that it would benefit the children to split their time 50 / 50 and thus are looking to split their costs 50 /50 rather than me paying any amount of maintenance per month. In real terms we will divvy up set outgoings and take responsibility for those expenses rather than trying to work out who's spent what each month. Any noticeable costs outside of the norm, such as school trips, will be split 50/50.

How formal does this have to be to protect both parties? Can we just write this down, counter sign it and keep a copy handy? Here's the text from the consent order:“And upon the applicant and the respondent agreeing that the applicant pays £500.00 pr calendar month in respect of child maintenance for the children, <names and DOB> until they reach the age of 18 or finish full time secondary education whichever is the later. This will be reviewed between parties annually”

Many thanks for your help and advice! David.
