child maintenance can't be back dated. If she isn't happy with the current private agreement, then the onus is on her to make an application to the CMS - but if he's not working then I can't see that she would manage to get more CM money from him.

I take it they have a Consent Order? If so, she will be legally obliged to pay him the sum of money set out in the consent order.
