Hi. I've read posts on this, and read information from the CMS, but still can't get a clear answer. My daugher is 18 and finishes her A-levels in June. She is not going to university and intends to get a job. Can anyone tell me if I need to pay child maintenance in July and August? My ex has inherited a quarter of a million pounds, so she does not need the money. There's no point asking her to let me off if legally she is entitled to the money. She will want it.

On what basis are you paying?

If it’s by private agreement you can stop whenever you want.

If there is a CMS assessment in place then you have to pay for July and August. Liability ends the first Monday in September.

Thanks for your reply. Yes it's a CMS assessment. Wow! She will be 18 and working and I still have to pay maintenance! Does that mean my ex keeps getting child benefit in July and August as well? Oh well, it's only 2 months. Thanks again for replying.

Is CMS paid in arrears, similar sort of situation but ours was a private agreement albeit using CMS rates but as our Consent was worded as being paid monthly in advance on the 28th so I'd assumed the August 28th payment is effectively paying for September (well a notional 3 days of August) so the July payment was the last "technically". Even googling though it seems CMS stuff can be treated as advance or arrears and isn't clear either

That's an excellent point. Thankyou. I pay on the 25th, so the August payment should only cover 6 days. I'll contact the CMS and let them know. Of course, I still support my daughter financially when she needs it. But it will be so much better than giving money to my ex!,
