Hi

Bit confused on this one.

On my Decree Nisi it states that I should pay "costs as litigant in person", even though she had a solicitor representing her. She is now wanting me to pay all of her solicitors costs and the court fees.

I am of the understanding that this really means that I should only pay for court costs. Is this the case or am I missing something????

Hi thanks for the reply. It states

I shall Pay the costs incurred on behalf of the Petitioner in this cause on a litigant in person basis only

It is less than clear. I would assume that it would be limited to disbursements which would be court fees and (as applicable) marriage certificate fee and process server/bailiff fees.

Even if you were expected to pay the costs incurred in relation to the work to obtain the divorce, the order would suggest that the rate of remuneration would be that of a litigant in person i.e. £9.25 per hour.

I think the judge ought to have ordered "the respondent pay the petitioner's costs limited to the reasonable disbursements incurred in the divorce suit"
