Hi

I am divorced, I have a financial order and my ex husband has defaulted on this , he owes me £20k lump sum as off november and £8300 in arrears in maintenance.

I now am finding my finances hard and need to enforce the order..

Can anyone help me i know i need to apply for a charging order agianst assests / property and then get an order for sale.

Can I do this myself? He is planning on selling properties ....

Many Thanks

Yes you can do this yourself but it is complicated, your best bet is too learn as much as you can, use the wiki search bar "how do i enforce a court order".

For now file form D11 with court, the form is in the wiki library, this gets you back to court with a judge who will decide what should happen next.

Don`t delay this has been left too long as it is.

With the D11 do I attach a copy of the Financial order?

Do i take it back to the court the divorce was granted?

Any help appreciated :-)

Yes to both.

Staple the order to D11, or it may get lost.

Take it to court, ask the nice person on the desk to check the D11 is correct and pay £90 which is the application cost.

Then its a waiting game, you both get a letter with a court date, you say what he has not done and what you need to happen and he offers reasons why he has not complied, the judge then decides what happens next.
