Can I claim court fees from stbx whos divorcing me

My husband is divorcing me. In the divorce petition, he hasn't ordered me to pay the costs of the application.

We tried mediation but he refused to return and said from now on everything is to go through our solicitors. He said he wants to waste as much of our money as possible so i'm left with nothing.

We agreed to exchange forms e early June but I am still waiting. His solicitor has requested for more time on a couple occasions. Their last letter said my husband hasn't given them further instruction.

I have now decided to take it to court.

Can I make a claim for court fees and legal fees for taking him to court? Or is this not possible if he is divorcing me? How does it work?

I am going to try arranging another date to exchange our forms e before applying for court.

The divorce is separate from the financial application.

In the divorce the petitioner can claim costs from the respondent but it sounds as though your spouse is not doing this.

In finances the starting point is that each party bears their own legal costs. It is possible to depart from this approach but as each party incurs monies from the matrimonial pot - as your finances are intertwined - it is not worth running up costs as it will effect both of you.
