Voluntary Redundancy

I am in line for a one off payment of circa £22k voluntary redundancy, still married awaiting the Absolute, can she claim against my payment?

I suppose I should ask what stage the financial proceedings have reached. Any change of circumstances, for better or for worse, can be taken into consideration before the order is made. It is appreciated you were probably unaware of the possibility of redundancy at an earlier stage.

I am pretty sure that your wife would have a claim agaionst your redundancy payment - at least in principle. But I've never managed to find out how the Courts treat such payments.

If you are redundant, or about to be, then clearly that has a bearing on the issue of maintenance, because you would not be able to afford very much for very long. In general people are not expected to pay maintenance out of capital, but there might be some sort of ' parachute payment ' to soften the blow a little bit.

So the answer to your question is, probably yes, but I wish I could tell you how much.

Im going through the same as yourself...been living apart gor a year and now gone for vol redundancy. I was under the presumtion that due to the fact that im going for vol redundancy after having moved out iver a year ago that its not classeh as a marital asset to be shared....
