I guess it depends on what assets you have, especially the marital home.

The only thing you can say about bankruptcy is that it wrecks your credit, and it can of course matter quite a bit if you own your home.

Do you own your own home and if so is it in joint names ?

Jointly own a home, which is in negative equity.

If you have no income or assets there is nothing for the Courts to redistribute.

In principle there is no reason why a house in negative equity cannot be used to provide housing for one or other of the parties as long as (s)he can afford the payments.

If you have children then you will have to pay nominal child support from your benefits. If you are bankrupt then you cannot afford spousal maintenance.

I am the bankrupt and have to represent myself.

No one lives in home, spouse left me to set up new home with new partner.

Spouse has paid all bills as spouse is not paying any where else as claims to be still living in our property and spouses company is paying for alternative accomodation 2 mins away from new partner as they believe him still to be living in marital home miles away.
