My wife and I separated in April 2012, I left her for another woman, my father died in May and left me a share in the house he lived in once it was sold (still not sold), in December my wife asked me for a divorce which I agreed to. She then did nothing for several months and the other day I had papers through to inform me that she had filed for divorce and wanted a lump sum payout for her and a lump sum for the children (we have three).
Currently I have no lump sum to payout, I may not have that for some considerable time as there has not yet been an offer on the house. I have no other assets and neither does she, the only thing we gathered during our marriage was debts which I now pay through an IVA. Does she actually have claim to my dads estate even though he died after we separated and I am still yet to actually inherit anything?

my father died last year 5 years after we seperated and even though I inherited a 1/3 share in a spanish flat and worthless Bankia shares the value was all offset against equity in our property :-)as we had not finalised the finances due to apathy!

Inheritances are a bit of a grey area in divorce however if the marriage was a long one and there are children involved it is likely that your inheritance will be considered if there is not otherwise enough in the ''pot'' to meet the needs of both parties.
