My stbx earns over £200k per year, I earn £25k a year. He is offering the minimum CMS payment and nothing else. This means that our children will suffer a huge drop in their standard of living. Once childcare costs are taken into consideration, there will barely be an child maintenance left and then he expects me to be able to house, clothe and feed the children on my small salary whilst he is free to take 80% of his salary to spend on what he likes. He now lives 2 hours away and does none of the day to day parenting. We’re waiting to go to court, but I’m terrified that he might get away with it and I’ll struggle to provide any kind of life for my kids, let alone the life they were used to having when we were a family of four.

If you need more from him, you can make an application for maintenance pending suit. This is spousal maintenance that is ordered by the court while finances are being sorted out. You would have to demonstrate a need and that he has the ability to pay. It sounds like that would not be too difficult. Lifestyle is also relevant up to a point.
