Hi everybody

At last we have some progress, my partners STBX has sent back the ACK of service but she has not completed the date she received the petition (Q2) and where it asks if she has received the statement of arrangements for the children she has indicated no in Q8a, left blank Q8b and in Q8c has remarked 'all children reside with me'

We have spoken to the court who assure us this was sent with the petition.

Their advice is to carry on with the application for directions to trial and that the judge should use common sense and know this was sent with the petition.

Any thoughts or advice would be appreciated.

Thanks.

Hi

If its just a case of she hasnt recived it and not that she doesnt agrea get her to fill another in, Judges dont use common sense and the advice i recived from court was pants.

My own affadavid was returned for a very minor error (the article was written in full) and the whole thing held up for a month.

You can send the d64 with the soa to save time.
