Hi,
Does anyone out there know???? I cant afford to get this answered as I have spent sooo much already on advice....
I filed in May and have never rec. a respondents form, I know ex hub rec it and I there is no point sending bailiffs as he is of no fixed abode right now.
Can I dismiss the file and what if he did sudently return the form would my petition still be valid from May???
be very grateful if anyone can answer.

Hello

If you dont recive Form D10 Acknowledgment of service and you believe your stbx will refuse to sign the petition ask the court for ballif serice to show every effort was made and oppertunity given for the petition to be signed.

If they still refuse to sign ask the court for affadavid of deemed service its doubtfull they will refuse if you have made every effort to get the petition signed.

Once deemed service is granted the process moves on to the next stage as though the petition was signed.
