I am a shareholder in a limited company with 2 other people,I have sent divorce papers to my wife ,is she entitled to any of the company assets,I was a shareholder before we met 3 years ago

I believe in the form E financial form you have to declare all company assets shares directorships etc

If the company has any funds showing or company vehicles etc is she entitled to claim them

I am actually going through a similar thing.

As you became shareholder before you got together, your shares would count as non-matrimonial assets and many Judges (but not all) do look at them differently to the matrimonial assets.

If your matrimonial assets have enough value to cater for her needs, then your shares should remain untouched.

If there is not enough in your matrimonial pot, then the Courts will look to supplement her needs from your non-matrimonial assets.

However, in all reality, there is a lot of luck as to which Judge you face.

I was told at mediation that shares in companies/directorships etc. are also looked upon as an ''earning vehicle''.
