I agreed to sell my FMH with my Ex about 20months ago....it took 6 months to get it on the market and was then marketed with a very small estate agent so there was not a lot of interest for a looooooong time. When we finally agreed to go multi-agent, there was a good offer made which we agreed on.

Following this, there were a few communications made on how the assets would be split following the sale, and she then told the estate agent to withdraw from the sale without consulting me !!!!

Can she actually do this ? The estate agent is absolutely livid (rightly so) and in my opinion we jointly agreed to the sale, so she can''t pull out like this !!! Additionally the couple who had agreed to buy the house are upset as they had spent money on surveys etc.

Any advice ?

Unless you have a court order she can.

It''s probably a good idea now you know value of FMH to discuss what percentage each party expects.

If there are children it will complicate the matter as a court would wish to keep a roof over there heads and so selling the FMH may not be in her interests as she may find it hard to find suitable accomadation if for example the council regards her as having made herself intentionally homeless.

Has she explained why she got cold feet?
