Hi,

Please Help:(

I wonder if you could answer these question?

I am at Decree Nisi stage and we are just sorting the finances out. We have been married for 15 years (separated for five years).
1. Will the separated time count as marriage time? (15 or 10 years)
2. My new partner has just moved in to my new house, am I at risk of causing financial implications?
3. Will my ex wife to be have claim on my property which I''ve just bought myself?
4. I have a military medical pension for ill health - can this be shared?

Hi,

courts can only look at your finances when asked to so you can be separated or even divorced for years before sorting it out but when you do sort it then it gets dealt with based on todays situation and figures not historical data.

Your ex wont have any claim on your new partners assets but having a partner may mean that you need less as things like fuel bills and housing costs will be shared so living together could have an indirect impact.

Yes your ex will have a claim on any assets you own as you are still married but if the new house is shared with your new partner then only your share can be taken into account.

Are you receiving the pension because you are unable to work? Is it your only income?
