My daughter does have her own money, as she does modelling too, she is living in halls, she has the full amount of grant from the gov, and has said to me she will get a job if she needs money.
My ex lived in the FMH for a year until it was sold and I payed for ALL expenses - even her personal exp, which left me with more debt, as I couldn''t live on the rest of my income!
The fmh has been sold and the monies has been split, this was, as stated split on the basis she bought the said property. even though I kept saying she can get a job and therefore a mortgage, that did not was with her or her solicitor, and mine did not push it!!! She didn''t purchase, she moved in with her mother and as far as I am aware she still lives there. I would guess she is sitting on at least £180k! where as I had £41k plus my pension, less the debts I paid (and still are). There is no reason why she cannot work, she just chooses not to! Because of my age I could only get a mortgage for 18 years (and that was a stretch)which bumped the repayments up. (£1351 a month!) even to get a 2 bed in this area I needed more than that as a deposit to be able to support myself!!

As you don''t have a full legally binding settlement, you should revisit it. You may have to fill in form E again to update your circumstances.

I am a bit surprised that money was released to her without a Consent Order in place. The risk now is that the sum will be eroded before you can sort a final settlement.

Presumably the agreement was worked out through solicitors and never got as far as the court. If you do have to go to court, you may need to self represent to keep costs down. What is the minimum you think she would need to house herself with?

I think she has about £180k in the bank, she can get a 2 bed house in the area she would want for between £150k & £160k..

I''m pretty certain she could get a mortgage for £30k which would only be a repayment over 20 years of £150!!!! Peanuts!!!

When I knew what she was like (her behaviour and lies over the last year has surprised me!) she wants to be mortgage free (her excuse - not working!!! - or rather doesn''t want to!!) - but then don''t we all!! and would sit on the money rather than spend it!!

Hi

After I sent the last post, I had a call from my ex. She says she has bought an apartment in November (which I can''t see how that would happen so quickly) she tells me she cannot pay the £502 - which is half the cost of the divorce, which has been ordered by the court for her to pay, and that she has spent all the money on the apartment, so has none left - however she said she spent ''most'' of the £48k in her ISA - I know she had more than that!!!

She also says she is not ''working'' but has been doing modelling jobs.

I know that 6 months after purchasing a property you can remortgage!!

Hi

There have been some new ''evidence'' so to speak. My new partner has been through the my old partnership (with ex) accounts and discovered that, even though Ex stated she had nothing to do with the business was regularly taking out money from the business. She added all this for the last few years, discovered a joint savings account which I had forgotten, after taking out what she would have put in her ISA, we have found that my Ex has at least £42,000 more than she said she had!!! We have found that my ex moved back into our FMH in December after moving out in Sept and then into her new property in March -after telling me she moved in in November!!!
I have applied to the courts for a consent order for a 50/50 split of equity - not the 72/28 it was and she repay half the business debts £9250. Her savings - which she could only have saved through me paying for everything for the house, should be put into the ''marital pot'' should it not?
