Hello,
We had our final hearing for 3 days from 24th Aug. We are now waiting for judgement due next week my stbx was concocting lies and the trial overrun .I am considering an application for costs order due to litigation conduct and dishonesty in his evidence. My legal bill is now £39,000 despite my self representation. What is the process of this costs application? Many thanks.

Kind Regards,

There is no simple answer to this. In family proceedings the general rule is that there is no order for costs. If you intend to apply for costs you would need to do so before the trial begins - or at the very least mention that a costs order would be appropriate.

Where judgment is deferred, it is often the case that the judge will give an indication that a costs order might be appropriate and invite the parties to make submissions on costs which would be either on paper or at a hearing when the judgment is handed down.
