Court bundle index for FDA hearing

Hi,
I am LIP and need to prepare and file the court bundle in just a couple of days. I would appreciate it greatly if someone could share an example index of where things go/order in the bundle in an example index. e.g. showing where the form E, es 2, mortgage capability statements etc goes.

I don't have an example but it would be worthwhile looking at the Practice Direction which gives you guidance.

Whilst you should comply with all of the practice direction, of particular interest are 3.1 and 3.2, 4.1-4.7, 5.1-5.3, 7.2-7.3, 7.5, 12.1.

Bear in mind that if the hearing is not in person i.e. by Skype, Microsoft Teams etc., the bundle has to be a PDF and must be indexed and searchable. Most domestic software cannot do this so be prepared.

If you are LIP courts are more accepting of an e bundle that isn't searchable etc. NB if the other party has a solicitor they will be expected to prepare the bundle.

It is important though to make it easy to navigate with good clear index (with court header). The first column should be the date the document was produced, then the document title and finally the page number. Merge all the sections into one bundle and add page numbers which then go on the index. Ilovepdf.com is free software that does this.

I would expect to see
Section A - ES1 and ES2,
chronology, statement of issues - agreed if possible but one each of not
questionnaires, form G and form H

Section B - applications and orders - in chronological order. Include divorce decree, sealed form A, notice of first appointment and any other orders in the matter.

Section C Statements and Affidavits: At FDA this will likely only be Forms E without enclosures.

Section D is miscellaneous documents. These may be property valuations, valuations for other assets especially if disputed) or any evidence that may explain why a particular question needs to be raised. You may also include mortgage capacity and examples of properties suitable to meet housing needs.

If you want you could put a very brief (one page) neutral case summary which should ideally be agreed with the other side.
