Hubby is leaving me... what do I need to do ?

Hi Everyone! Didn't expect to find myself here but last week my husband announced he didn't want to continue our marriage.

We married in 2016 and have 1 child who has just turned 2 years. He owns the house we live in (purchased whilst we were a couple but not married) but I have lived here since day 1. We had a pre nup but I believe that was listed as void if we had children (but need to check).

He wants to move out and rent for a few months for some space. He seems quite set that there is no chance for us but I said he was jumping straight to divorce and not giving some time apart a chance. I would do anything in my power to work on our relationship due to us having a child together, I do not want to break up.

I plan to stay in our home as my child is settled in her nursery and i have a part time job. My only other option is to move back to my parents an hour away but commuting costs are so high it would not be worthwhile keeping this role (that I only just started last year and love and provides great flexibility which will be perfect for when my child starts school). I dont want to disrupt my child and move them to a different home and nursery unless I know 100% that our marriage is completely over.

I believe there are other issues affecting our relationship and we could work at resolving a number of issues he raised if we really try.

Can anyone advise me on what is best to do for me and my child- I was told if I moved out our home that is legally bad but I am not clear on why? As we have to be separated for 2 years before we can apply for a divorce, how can I financially be secure during this time (whilst living in the home I do not have household bill's to pay) How is child support calculated as my husband does not earn a wage but makes only commission?

Register a home rights notice on the house to protect yourself.

Discus child maintenance with your husband. Check CMS calculator for an idea of amounts. Don't mess around go straight to CMS calculation if he doesn't engage and start paying immediately.

Check what you can claim benefits wise and get it done.

Suggest relationship counselling to your husband as you clearly don't think it is definitely over yet.
