Hi going through hell with ex, who is living in a house that she can not afford, state handouts not working, l have paid the Mortgage as stated Undertaking Statement and that she took the Undertaking Statement that after that she would pay but since has advised that will find it difficult in which if she can not full fill her Undertaking Statement I can take her back to court.
I have asked to sell the house but she is aware then she will lose all benefit from state and any legal aid but can rent and get on with life, yes 2 children 16 / 12 year old involved.
What's the best solution and that she has alienated me from the children and is using the children against me. At present, I'm unable to rent have saved up but not enough.

Dj Smith - where are you in the divorce process? You refer to an undertaking, do you have a Consent Order approved by the court?

Are you still named on the mortgage? If you cannot afford your own place/rent due to paying mortgage on a house you do not live in then selling seems the only sensible option before the banks take it.

Hello DJ Smith. Is she saying that a lump sum from a house sale would disqualify her from means tested benefits? I always thought that there was a 6 month window allowing time to purchase another property if in receipt of a large sum such as an inheritance.
