Hi,

Since the ex is taking the case to child maintenance service as she does not want me to pay the computation of gov.uk based on my half pay because of illness, what would I expect the CMS is going too do now?

I used to pay the full mortgage of 1K until March, and she would like to ask the CMS about back dated payment from APRIL. Can she actually do that and CMS will agree with her? If she ask for back dated claim, Can I challenge that by saying I paid the fulll mortgage and that could be my 2 months child maintenance each month mortgage?

CMS will look at your income and make an assessment. That is then the amount payable.

The applicable date will be the date of application. They don't backdate assessments.

They get the information from HMRC.

If you have a change in circumstances of more than 25% they can review.

Why are you on half pay and how long will it last?

Half pay as had accident last December and not been back to work since then. Comatose in.ICU, subarachnoid haemorrhage and had 2nd operation last week.
