Hi there. I married a man 5 years ago unaware he was a drug addict and has been since he was 16 years old, he is now 51. I lived with him after we married due to him being in prison to which he told me he had committed a crime. Later found out that he has a life long criminal record and addiction. The first year of our marriage I set up a business, all in my name and he was working for the me.. He was paid and was on PAYE. He then became in the throws of his addiction again and was recalled back to prison. So he has spent 3 years out of our 5 years of marriage in prison. I carried on running and growing the business while I filed for divorce. I have the absolute. He is now back on drugs telling me he is going to claim on the basis he helped grow my business. I am waiting in a draft for a Clean Break but he keeps changing his mind about signing (probably wants money for drugs) Would a judge honor any of his claims giving his addiction and criminal record? He is at no fixed abode and not working. I have one dependent who is a student (not his child) Thank you. The fear i have is not nice especially with his behaviour. Also, I should have added. He will probably go back to prison again soon so then how would I get a clean break from him?

If he doesn’t consent then he won’t sign the Consent Order.

You need to apply to court then if you can’t come to an agreement, which seems unlikely, the court will make the decision for you.

Realistically it is the only way you’re going to get it resolved.
