Hi There

Im going through the divorce process

we’re not at the Consent Order state yet

been married nearly 23 years

it’s my family home that i had lived in 46 years and we had it renovated

Son is 19 currently living in the property on his own as husband works out in Saudi and has accommodation out there

his idea of a fair split is

I keep the car (which im giving him the monthly) payments for to pay the finance at the end in 3 years he pays the balance approx £19,000

he keeps the property which is a 5 bedroom 3 bathroom bungalow at approx £400,000

Currently living

he’s threatening to take the car off me which is in my name and stop the payments if I don’t agree to it

Need some advice of what to now as I also have debts and a loan to pay so don’t have much spare for legal advice

Thankyou
Rach

On the face of it, that's a long way from being fair.
Is the FMH the only property you have? Where are you living now?

23 years is a long marriage so the start point for division of all assets is 50:50.

You may have to fund your own car but should have a decent share of the assets to do that with.

Have you gone through full financial disclosure?

Are there other assets to consider?
Are the debts etc matrimonial?
Do you, or he, have pensions?
Is he employed by a UK based company?

You may want to have a look at the low cost services we provide for people who don't want (or cannot afford) to engage a solicitor. This includes a fixed price legal financial consultation. You can used the button on this page to book a free short consultation to look at your matter.

Have a good read of the site to make sure you understand more about how financial settlement works. You really need to start with full financial disclosure. Debts that were built up during the marriage and even those post separation may be met from the matrimonial pot.
You each have a strict need for a 1-2 bed place even if you are currently cohabiting.
Pensions should be shared to equalise incomes in retirement. Yours is a long marriage so 50:50 of everything would be the start point although that may not be how things end up if he is in a much better financial position than you.
