Can anyone help with a question about calculating eligibility for legal aid for a discharged bankrupt? If the Legal Services Commission are still considering a claim made in Oct/Nov 2010 (under the old rules), can they take into account the value of the former marital home when a form J has been registered? The bankruptcy was discharged last year but the form J is still registered and my ex remains in the property. The house is either in or near enough to negative equity and a secured loan is in place additionally on the property.
