Hi
I currently have a Solicitor but due to unexpected family circumstances he is away from work so I am hoping someone can offer me some advice on here please.
My partner(never married) has left me and at the moment I live in the property with my 3 children 2 of which are disabled. I have paid the Mortgage by myself since he left and my solicitor has put forward a offer to try and finalise the situation . Due to being unable to work due to the complex needs of my Children the best offer I have been able to put forward is a 33/67% split my ex is demanding a 50/50 split plus another issue is I am unable to remortgage in my own right which he is aware of due to being on benefits so am unable to get his name taken off the mortgage he is also demanding his name is taken off the mortgage and if I am unable to do this he will look force me out of the property by buying me out. I want to stay in the property as my children are safe and settled here and am able to pay the mortgage can he force that he buys me out under these circumstances ?
Any advice would be appreciated
Thank you

Hi, If you have a solicitor, the firm will have another solicitor that should be able to assist you while yours is away.

Only a Judge can make a decision about your house, and they will look at the needs of your children, you do not say how old your children are. They will look at their needs both now and in the future.

Does your stbx have a solicitor? Is there equity in the propety? What other debts or assets do you have? Do either of you have a pension?

There are a lot of other factors that also come into play.
