I fall into Remarriage trap, what I can expect? How to protect myself?

Hello everyone,

I have been married for 13 years. Divorced in May 2021. Decided to divorce as there was nothing between us any longer. Although we have 2 children.
We haven't got any assets together, he haven't got any pension and mine was never attached to his name, no property (we were renting all these years), no investments. There was nothing valuable on our join names.
I was the applicant, however as there was nothing to share I did not tick that box.

The children live with me all the time, the ex visiting them once a month maybe and not even once took them for overnight stay to his place.

Now, as I did my own divoce online I have absolutely no idea about remarriage trap.
My ex was ok. We settled some child maintenance and I couldn't be bothered to deal with him to ask for anything more (he pays £130 a month).

Now begging of the year he came with proposal to do Consent Order, however as we have kids I have been told to do Clean Break order.
I started to read more about it all and found myself into the trap, that I am vulnerable after marrying again.
The only thing is he doesn't know that I am remarried.
He knows that I am living with someone and he is supposing I am married.

My question is, if we havent got anything together during marriage, can he claim anything from me now? What if I will purchase property with my current spouse? What if my financial situation will improve? What sort of claims and on what ground he can make against me without clean break order?

Or shall I just not mention the fact that I am married again and let him do the claim? Once he will find out he will stop it?

I appreciate any advice here as I am very lost into this situation and wondering if there is anything I can do to support myself and my spouse from the potential ex claim in the future?

Were you the applicant in the divorce?
If you ticked all the boxes about financial applications then you may have avoided the remarriage trap.
If that is the case best thing to do is sort out a clean break order ASAP.

Thank you for your reply.

I did not tick any boxes unfortunately, as there were no assets to share and no financial contributions between us except for the children we both agree for me to stay with.

Therefore my question is what I can do now in this case?

The only thing you can do then is ask your ex to make an application for a clean break now.

Until you have a clean break order, or they remarry, they will always be able to make an application.

They can apply for a court order to separate your finances.
You will both have to make full financial disclosures and agree how your finances will be split.
