Question: is the calculation of child maintenance using the online tool an acceptable benchmark? i.e. accepted widely by courts/judges?

Question 2: If one's ex-wife has a child and is engaged to a 'new' partner and that he is always present at the ex's property (doesn't have his own property) sufficient to determine that paying fair (see above) child maintenance is acceptable and sensible?

Are there any obvious circumstances where payments over and above the CSA calculation for child maintenance would be indicated? (in the absence of any court order - which there isn't)

If you are based in England or Wales and don't earn over I think it's £150k then the courts have nothing to do with the calculation of child support.

"Question: is the calculation of child maintenance using the online tool an acceptable benchmark? i.e. accepted widely by courts/judges?" - They have no choice.

"Question 2: If one's ex-wife has a child and is engaged to a 'new' partner and that he is always present at the ex's property (doesn't have his own property) sufficient to determine that paying fair (see above) child maintenance is acceptable and sensible?" - This is not going to affect child support at all. It would affect spousal maintenance if you are currently paying or have been asked to pay by your ex.

"Are there any obvious circumstances where payments over and above the CMS calculation for child maintenance would be indicated? (in the absence of any court order - which there isn't)" - As stated if you earn over a certain amount of don't live in the UK then you could have to pay more because it will be dealt with by a court order otherwise no, just use the calculator and then pay that amount.

CMS have jurisdiction not the courts. Courts only deal with child maintenance by consent so if you're not in agreement then it will need to be CMS.

New partner won't have any affect upon amount payable.
