Hi. I'm anticipating a pension sharing order from the judge.
Does this need to actually have been processed by the pension company before the Clean Break becomes effective or is it once the judge awards it, regardless of how long the pension transfer takes? (Ex can be very obstructive).

The PSO is part of the final financial order by consent or imposed by a judge. The order is activated by Decree Nisi/final order in the divorce.
Once papers for the PSO have been sent to the Trustees of the pension scheme they have four months to implement the pension share.

NB Depending on the size and type of pension an actuary may be needed to calculate how pensions should be shared to equalise income in retirement.

That's good to know, thank you. Ultimately then, once the judge issues the PSO, even if my ex refused to respond to the pension company, it would have no bearing on the clean break being actioned!?
