20 yrs+ Post divorce claiming against ex-husband's pension

Morning,

I would like to know if I can claim against my ex husband's company pension? We divorced in 2001 and I did not claim against his pension. We have remained friends and unfortunately he has terminal cancer. We were together 20 odd years bringing 3 children. This request has arisen because his most recent ex wife despite only being married to him for 2 years whilst he worked is after his pension. My ex and my children have asked me to the same to stop her getting so much. If I can claim, what documents do I need to start this action ? Further information, I never remarried and am on a low income.

No ... I chose not to have a solicitor and all correspondence was between myself and my ex husband's solicitor. A court didn't rule on it ... it was between myself and my ex husband.

So how did you divide things up at the time?
Do you have any documents from back then?
What sort of pension is it and how long does your ex have left?
Have they expressed any wishes in this?

We agreed on 65/45 re the house which would have equated to £260k. I only received £225k. He was supposed to give me the balance when he sold the property but despite selling the property I never received the monies owed. Unfortunately, I cannot find any documents except for a Decree Nisi. His pension with IBM was a final salary scheme I believe but I could be wrong. I know whilst we were married he paid in extra AVCs into it and I found after the divorce his pension was worth in the region of £800k. He received a large lump sum and £40k a year. He's been told he has up to 2 years left. If you mean my children .... they want me to ho for his pension and husband will not contest.
